These Terms & Conditions govern your use of AgriBid Zambia ("AgriBid", "we", "us", or "our") — our website, seller portal, auction services, listings, and messaging features.

By creating an account, browsing, bidding, or listing on the platform, you agree to these Terms. If you do not agree, do not use the platform.

1. About AgriBid

AgriBid is an online agricultural marketplace and auction platform that connects buyers and sellers of livestock and related agricultural assets in Zambia.

The platform allows users to:

  • List livestock and agricultural assets for sale;
  • Participate in timed auctions or fixed-price sales;
  • Communicate regarding listings and transactions;
  • Make and receive payments through approved payment channels;
  • Promote agricultural trading opportunities.

AgriBid acts as a digital marketplace facilitator and is not the owner of livestock listed by sellers unless explicitly stated.

2. Eligibility

To use AgriBid, you must:

  • Be at least 18 years old;
  • Have the legal capacity to enter into binding agreements;
  • Provide accurate registration information;
  • Comply with all applicable laws and regulations in Zambia.

Businesses registering on behalf of organisations confirm that the registering user has authority to act on behalf of that organisation.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. User Accounts

Users are responsible for maintaining the confidentiality of their login credentials and for all activity conducted through their accounts.

You agree to:

  • Keep your password secure;
  • Notify us immediately of unauthorised account access;
  • Ensure your account information remains accurate and updated.

AgriBid may suspend, restrict, or remove accounts involved in fraud, abuse, manipulation of auctions, or violations of these Terms.

4. Seller Responsibilities

Sellers using AgriBid agree that:

  • They are the lawful owners or authorised agents of listed livestock or assets;
  • All listing information is accurate, complete, and not misleading;
  • Animals are properly described, including breed, age, condition, vaccination status, and health records where applicable;
  • Listings comply with Zambian veterinary, livestock movement, and agricultural regulations;
  • They have the legal right to sell the listed items.

Sellers must not list:

  • Stolen livestock or property;
  • Illegal products;
  • Diseased or quarantined animals without proper disclosure;
  • Fraudulent or misleading listings.

AgriBid reserves the right to remove listings that violate platform rules or applicable law.

5. Buyer Responsibilities

Buyers agree that:

  • Placing a bid constitutes a legally binding commitment to purchase if the bid wins;
  • They will review listing details carefully before bidding or purchasing;
  • They are responsible for arranging transport, inspections, permits, and collection unless otherwise stated;
  • They will complete payment within the required timeframe.

Failure to complete payment may result in:

  • Account suspension;
  • Permanent restriction from bidding;
  • Cancellation of winning bids;
  • Additional recovery or administrative charges.

6. Auctions and Bidding

AgriBid may provide both auction-style listings and fixed-price listings.

6.1 Auction Rules

  • Auctions run for the time period shown on the listing;
  • The highest valid bid at closing wins the auction;
  • AgriBid may extend auction closing times in cases of late bidding or technical interruption;
  • Sellers may set reserve prices where applicable.

6.2 Binding Nature of Bids

All bids submitted through the platform are binding.

Users may not:

  • Withdraw bids without valid reason;
  • Manipulate auction pricing;
  • Use fake accounts to influence bidding;
  • Interfere with other users’ participation.

AgriBid reserves the right to cancel suspicious bids or suspend accounts involved in auction manipulation.

7. Payments

Payments may be processed through approved payment methods including bank transfer, mobile money, card payments, or other supported services.

By using the platform, users agree that:

  • Payment timelines shown on listings are enforceable;
  • Platform fees, commissions, or buyer premiums may apply;
  • AgriBid may temporarily hold funds where necessary for fraud prevention or dispute resolution.

AgriBid does not guarantee uninterrupted payment processing and is not responsible for failures caused by third-party payment providers.

8. Fees and Commissions

AgriBid may charge:

  • Seller listing fees;
  • Commission fees;
  • Buyer premiums;
  • Promotional or advertising fees;
  • Transaction processing fees.

Applicable fees will be displayed on the platform or communicated before transactions are completed.

AgriBid reserves the right to update pricing or fee structures at any time.

9. Delivery, Collection, and Transport

Unless otherwise stated in a listing:

  • Buyers are responsible for transport and collection arrangements;
  • Risk transfers to the buyer upon collection or confirmed delivery;
  • Sellers must cooperate in providing required livestock documentation.

Users are responsible for complying with animal transport laws, movement permits, veterinary requirements, and biosecurity regulations.

10. Animal Health and Welfare

Sellers are responsible for accurately disclosing known health conditions and vaccination status.

AgriBid encourages humane treatment and responsible handling of animals. Any reports of animal cruelty, illegal trading, or unsafe conditions may result in account suspension and reporting to relevant authorities.

AgriBid does not independently verify animal health unless expressly stated.

11. Disputes Between Buyers and Sellers

AgriBid may assist in resolving disputes but is not obligated to act as an arbitrator.

Users are encouraged to resolve disputes directly.

Where necessary, AgriBid may:

  • Review transaction records;
  • Suspend accounts during investigations;
  • Reverse or withhold platform privileges;
  • Share information with authorities where legally required.

Final responsibility for transactions remains between buyers and sellers.

12. Prohibited Conduct

Users must not:

  • Use the platform for unlawful activities;
  • Submit false or misleading information;
  • Attempt to hack, disrupt, or damage the platform;
  • Upload harmful software or malicious code;
  • Harass, threaten, or abuse other users;
  • Circumvent platform fees or conduct off-platform fraud.

Violation of these rules may result in suspension, permanent bans, or legal action.

13. Intellectual Property

All AgriBid branding, website content, logos, software, graphics, and platform materials are owned by or licensed to AgriBid.

Users may not reproduce, copy, distribute, or exploit platform content without written permission.

By uploading content to AgriBid, users grant AgriBid a non-exclusive licence to display and promote listings on the platform and related marketing channels.

14. Platform Availability

We aim to keep the platform operational at all times but do not guarantee uninterrupted access.

AgriBid may:

  • Temporarily suspend services for maintenance;
  • Modify platform features;
  • Restrict access for security reasons.

We are not liable for losses caused by downtime, technical errors, internet failures, or third-party service interruptions.

15. Limitation of Liability

To the fullest extent permitted by law:

  • AgriBid is not responsible for the actions of buyers or sellers;
  • We do not guarantee the quality, condition, health, legality, or suitability of listed livestock or assets;
  • We are not liable for indirect, incidental, or consequential losses arising from platform use.

Users transact at their own risk.

Nothing in these Terms excludes liability that cannot legally be excluded under Zambian law.

16. Indemnity

Users agree to indemnify and hold harmless AgriBid, its owners, employees, affiliates, and partners from claims, damages, liabilities, costs, or expenses arising from:

  • Breach of these Terms;
  • Misuse of the platform;
  • Violation of laws or third-party rights;
  • Disputes related to listings or transactions.

17. Privacy

Use of the platform is also governed by our Privacy Policy and Cookie Policy.

By using AgriBid, users consent to the collection and use of information necessary to operate the marketplace.

18. Suspension and Termination

AgriBid may suspend or terminate accounts without prior notice where users:

  • Breach these Terms;
  • Engage in fraudulent activity;
  • Fail to complete transactions;
  • Damage the integrity or reputation of the platform.

Users may stop using the platform at any time.

Outstanding obligations existing before account closure will remain enforceable.

19. Changes to These Terms

AgriBid may update these Terms from time to time.

Updated Terms become effective once published on the website. Continued use of the platform after updates constitutes acceptance of the revised Terms.

20. Governing Law

These Terms are governed by the laws of the Republic of Zambia.

Any disputes arising from use of the platform shall be subject to the jurisdiction of the Zambian courts.
